Terms and Conditions

In these conditions:

“BLC” means - Belper Leisure Centre Limited

“the Centre” means - Belper Leisure Centre owned by BLC

“Palms” means – Palms Health and Fitness

“the Manager” means – the current Manager of the Centre

“Terms and Conditions” means – these terms and conditions and any amendments made to them by BLC pursuant to clause 42

 

Correspondence

  1. All correspondence should be addressed to: The Manager, Palms Health and Fitness, Belper Leisure Centre, John O Gaunts Way, Belper, Derbyshire, DE56 0DA.

 

Joining Palms

2.Membership of Palms is subject to the completion of an official application. Upon acceptance by BLC, members will receive a copy of the completed membership form.

3.Subject to clause 8, membership of Palms is non-refundable and is transferable only in accordance with these Terms and Conditions.

4.Subject to changes to these Terms and Conditions, there is no minimum membership contract.

5.At the time of joining, a separate administration fee (“Membership Administration Fee”) must be paid in advance by all new members.

6.Members who join on or before the 14th of the month must pay the first month’s membership fee on a pro rata basis in advance.  Subsequent payments of the membership fee will be made by direct debit.

7.Members who join on or after the 15th of the month must pay the first month’s membership fee on a pro rata basis and the membership fee for the following month in advance.  Subsequent payments of the membership fee will be made by direct debit.

8.All monies paid to BLC in respect of the membership will be refunded in full should the member terminate their membership within 48 hours of joining.  This right to terminate does not apply to memberships transferring under clause 9.

 

Transfer of membership

9.Members who pay annually or for a fixed time period in advance are not permitted to terminate their membership but may transfer their membership to a family member or friend (unless such person is currently a member of Palms at the time of transfer).

10.Members who pay their membership on a monthly basis by way of Direct Debit are not entitled to transfer their membership.

11.The Membership Administration Fee will not be refunded upon transfer.  All parties concerned are required to complete the relevant paperwork within Palms. Failure to comply with these Terms and Conditions will render any membership transfer void.

 

Termination

12.Members who wish to terminate their membership must give notice on or before the 20th day of the month by completing the correct paperwork at Palms.  For the avoidance of doubt, notice given on or after the 21st day of the month will result in the final payment being debited for the following month.  In the event that such notice is not given BLC reserves the right to recover the membership fee payable during the notice period.  This clause does not affect the right of new members to terminate within 48 hours of joining.

13.BLC reserves the right to terminate a membership at any time in the event of non-payment of membership fees or failure to comply with these Terms and Conditions.  Any monies outstanding at this time will be a debt due to BLC and may be recovered in such a manner as BLC sees fit.

14.Upon termination of membership all membership cards and Techno Gym Keys must be returned to BLC.  Members who fail to return membership cards and Techno Gym keys may be billed for their replacement. The membership card and key remain the property of BLC at all times.

 

Freeze

15.In the event that a member’s circumstances prevent usage of Palms for a long period of time (such as working away, serious illness, injury or pregnancy) BLC may (at its absolute discretion) temporarily suspend the membership for an agreed period of time (“Freeze Period”).

16.A Freeze Period may be a minimum of 1 calendar month and up to a maximum of 6 calendar months.

17.All members who wish to suspend their membership must give notice to do so by completing and signing the appropriate paperwork at Palms.  The paperwork must reach BLC strictly on or before the 20th of the month prior to the first month in which membership is to be suspended.  If the membership is joint, both members will be required to sign the appropriate paperwork.  BLC will not suspend any membership without the relevant paperwork being signed.

18.BLC reserves the right to request evidence of the member’s reason for seeking suspension of membership.

19.Members will not be permitted to use Palms facilities (including Palms classes) during any Freeze Period except at the Manager’s discretion.

20.Monthly Direct Debit memberships: Members on a single monthly Direct Debit membership will be charged a reduced fee of £5 instead of the normal monthly fee, for each month during the Freeze Period.  This must be paid by Direct Debit.  At the end of the Freeze Period the monthly membership fee will revert back to the full price.

21.If members on a joint monthly Direct Debit membership both wish to suspend their membership they will be charged a reduced fee of £5 instead of the normal monthly fee, for each month during the Freeze Period.  This must be paid by Direct Debit.  At the end of the Freeze Period the monthly membership fee will revert back to the normal monthly fee.

22.If one member on a joint monthly Direct Debit membership wishes to suspend their part of the membership then the continuing member will be charged at the current rate for a single membership for each month during the Freeze Period. At the end of the Freeze Period the monthly membership fee will revert back to the full price. 

23.Annual memberships: Members on an annual membership will not be charged a fee to suspend their membership.  Joint members on an annual membership must both suspend their membership at the same time. Annual members can give notice to freeze their membership any time up to the 1st of the month that they intend to freeze. Notice given on or after the 2nd day of the month will result in the freeze taking place the following month. The Freeze Period will be added to the term of the membership.

 

Fees

24.BLC reserves the right to review the Membership Administration Fee and membership fees at any time. Members who pay by way of monthly Direct Debit will be given 10 working days notice of any membership fee change.  Notice of annual membership increases will be displayed in Palms for one week prior to the increase.

25.BLC reserves the right to carry out maintenance to the facilities and equipment within Palms at any time. Whilst every attempt will be made to provide advance notice of such maintenance it may, in the event of full and prolonged closure of the facility, offer compensation if it considers it appropriate at its absolute discretion.  Compensation will not be authorised with prolonged closure of the Health or Fitness Suite or any equipment within this area.

26.BLC reserves the right to change the hours of business, activity programmes and refuse admission where it considers it appropriate at its absolute discretion.

 

Conditions

27.All members are required to swipe their membership card at reception on each visit to the Centre.  Members will only be permitted access to activities within their Palms membership if they produce their membership card on every visit. Failure to comply with this may result in the member having to pay the current price for the activity.

28.Members shall be responsible for the safe keeping of all membership cards and Techno Gym Keys issued by BLC. If a member loses their membership card or Techno Gym Key they shall be required to pay for the cost of a replacement card/key.

29.Members shall be responsible for, and shall pay to BLC on demand, the cost of any damage caused by them to the Centre or Palms or any part thereof including any, facilities, furniture, fittings apparatus or any other contents.

30.Each member indemnifies BLC from and against all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, and all legal and other professional costs and expenses) arising out of or in connection with any claim made against BLC in respect of any injury, loss, or damage to property arising out of or in connection with their actions or omissions.

31.Any property found in the Centre which is believed to be lost will be dealt with in accordance with the Centres’ lost property policy.  BLC accepts no responsibility for any loss or damage to any personal property, articles or equipment at the Centre howsoever caused. Members are fully responsible for their own property whilst using Palms and the Centre.

32.Children aged 15 years and under will not be permitted to enter Palms except junior members during Club Fitness sessions or specific supervised times. Proof of date of birth may be required. Children who are 16 years or over will be deemed to be adult members.

33.For safety reasons and to avoid disappointment, members are required to pre-book certain activities provided by Palms, for example, group exercise sessions. Members who cancel a pre-booked activity may be frozen from booking future activities. Please see separate terms and conditions for specific group exercise sessions.

34.Members who wish to cancel a pre-arranged appointment, must provide 48hrs notice. In the event that such notice is not provided, BLC reserves the right to charge a cancellation fee. Members who do not arrive at the allocated time may be asked to re-book the session, regardless of the reason.  BLC reserves the right to cancel or postpone appointments for any member at any time.

35.Rules, guidance and information provided on the use of any facilities must be observed by members at all times. BLC will not be liable for damage, loss or harm whatsoever, howsoever caused as a result of any failure to observe the said rules or guidance and information.  BLC reserves the right to amend any policy, procedure or rules associated with any area or facility assigned to Palms for member’s usage.

36.All customers and members using the facilities are required to complete a Health Commitment Statement in advance. All members are responsible for seeking advice from their G.P prior to commencing any exercise programme. At any point in the membership BLC reserves the right to request confirmation from the GP that the member is fit to use the facilities.  Whilst BLC await the outcome of the confirmation the member may be prevented from using their membership.

37.Members should wear suitable footwear and clothing within Palms and also use a workout towel while using Palms. Shaving is not permitted within Palms. Members are required to adhere to the Palms etiquette notices. Any member not observing theses guidelines may have their membership revoked.

38.To avoid any danger or inconvenience to yourself and other members of Palms, members should not use a mobile telephone or lap-top whilst in Palms.

39.Members are requested to report any damage to the equipment or facilities to a member of Palms staff.

40.Members are not permitted to bring any unauthorised guests into Palms nor allow anyone to use the facilities free of charge.  Any member found allowing a guest to use Palms free of charge may have their membership revoked.

41.The free use of Sammy’s Function Suite is for Palms members over the age of eighteen and will be limited to one function per year per membership. All bookings will be subject to the availability of Sammy’s Function Suite and subject to the terms and conditions of the Facility Hire Application Form (as available at the Centre reception). Members can use their membership status to book for themselves or a family member living at the same address. Proof of address must be presented at the time of booking. Members are not permitted to use their membership status to secure bookings for friends, organisations or colleagues. In this instance bookings will be taken at the Managers discretion. The booking must require a licensed bar.  Any outstanding monies on the membership account must be settled prior to the function.  BLC reserves the right to amend or cancel any free booking or withdraw the above right at any time.

 

Changes to these Terms and Conditions

42.BLC reserves the right to amend or modify these Terms and Conditions from time to time. BLC will give members 14 days notice of any intended amendment to the Terms and Conditions by displaying a notice on the BLC website at www.belperleisurecentre.co.uk and in reception at the Centre. The amendment shall take effect on the 15th day after the notice was posted. In the event that a member disagrees with the proposed amendment that member may terminate its membership by giving notice to BLC in accordance with clause 12.

 

Comments

43.Members wishing to make any comment in respect of the Centre or Palms can do so either by writing or by filling out a customer comment form.

 

Interpretation
44.Any questions arising as to the interpretation of these Terms and Conditions shall be determined by the Manager. Their decision shall be final.
